A Leitchfield father and son are suing multiple law enforcement officers, the city of Leitchfield, Grayson County, the Leitchfield Police Department and Grayson County Sheriff’s Office.
Lannie Fentress and his son Daron Fentress are suing suspended LPD Sgt. D.J. Newton, LPD Officers Justin Cockerel, Brian Jennings and Tamara Jupin along with Grayson County, the Grayson County Sheriff’s Office and Deputy Thomas Lane in U.S. District Court in Owensboro.
The suit stems from a residential fire on Rison Drive on June 9, 2024, where the Fentress’ refused to leave their burning home but were forced out of the residence by responding officers and arrested.
Count one of the lawsuit accuses law enforcement officers of excessive force and cruel and unusual punishment; count two claims assault and battery; count three claims negligence; count four accuses the defendants of false arrest and imprisonment; count five claims malicious prosecution; count six accuses the defendants of abuse of power; counts seven and eight claim professional malfeasance; count nine accuses the city of Leitchfield, the Leitchfield Police Department, Grayson County and the Grayson County Sheriff’s Office of negligent hiring, retention, supervision and training.
The suit seeks a trial by jury and a “reasonable sum to compensate the Plaintiffs for their injuries and damages, including past and future lost wages, recovery for physical, mental and emotional distress, pain and suffering, embarrassment and humiliation, and all other compensatory damages recoverable by law” in addition to attorney’s fees and punitive damages.
