Alleged underage drinking, drug use at large New Year’s Eve party leads to arrest of Breckinridge Co. man, his son

A Breckinridge County man and his son have been arrested after a New Year’s Eve party spiraled out of control.

Sunday morning at approximately 1:00, Kentucky State Police and the Breckinridge County Sheriff’s Office responded to the 9800 block of Hwy 401, about 2.5 miles south of Custer, on the report of “physical fighting” at the party.

Upon arriving at the scene, police discovered an outdoor party attended by “over 100 people,” according to the arrest citation. A witness told K105 the party had between 200 and 300 attendees, with 75 percent of the party-goers appearing to be teenagers.

Prior to Kentucky State Police arriving on scene, deputies “observed multiple juveniles partaking of marijuana and alcohol,” the citation states.

The man on whose property the party was taking place, 42-year-old Timothy A. McKellar Sr., was “admonished (by police) three times to break up the … underage drinking and he refused,” according to the citation. Additionally, after being told that he would be charged with a crime if he failed to “take control of the situation,” McKellar continued to ignore KSP’s commands.

Three attendees who left the party “did donuts in a neighboring yard, then assaulted the (elderly) homeowner,” the citation says.

McKellar told police he frequently hosts parties on his property and knew beforehand about the New Year’s Eve party and “agreed to host it.”

He was arrested and charged with second-degree unlawful transaction with a minor, third-degree unlawful transaction with a minor and obstructing emergency responder violations. McKellar was lodged in the Breckinridge County Detention Center but is no longer listed as an inmate.

McKellar’s son, Timothy McKellar Jr., 21, was also arrested and charged with second- and third-degree unlawful transaction with a minor.
