Fiscal Court votes to make Grayson Co. a Second Amendment Sanctuary county

At Tuesday morning’s Grayson County Fiscal Court meeting, magistrates unanimously voted to approve Grayson County as a Second Amendment Sanctuary county.

The resolution states in part:

The Second Amendment to the Constitution states, “A well-regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed” and the United States Supreme Court has affirmed an individual’s right to possess firearms, unconnected with service in the militia, for traditionally lawful purposes, such as self-defense, within the home, and the United States Supreme Court has affirmed that the right of an individual to “keep and bear arms,” as protected under the Second Amendment, is incorporated by the Due Process Clause of the Fourteenth Amendment against the states …

Whereas, the Grayson County Fiscal Court is concerned about the passage of any bill containing language which could be interpreted as infringing the rights of the citizens of Grayson County to keep and bear arms, and, the Grayson County Fiscal Court wishes to express opposition to any law that would unconstitutionally restrict the rights of the citizens of Grayson County to keep and bear arms …

Whereas, the Grayson County Fiscal Court wishes to express its intent to stand as a Sanctuary County for Second Amendment rights and to oppose, within the limits of the Constitution of the United States and the Commonwealth of Kentucky, any efforts to unconstitutionally restrict such rights …

The Grayson Count Fiscal Court hereby declares its intent to oppose any infringement on the right of law-abiding citizens to keep and bear arms.

A Second Amendment Sanctuary, also known as a gun sanctuary, refers to local or state governments that have adopted laws or resolutions intended to prohibit or impede the enforcement of certain gun control measures perceived as violating the Second Amendment, such as universal gun background checks, high capacity magazine bans, assault weapon bans, and red flag laws.

Judge-Executive Kevin Henderson and Commonwealth Attorney Rick Hardin were sure to note that the passage of the resolution does not indicate guns may be carried in schools, courthouses, airplanes or anywhere else firearms are expressly prohibited (the judge noted that his office has received multiple phone calls from citizens asking if they, after the passage of the resolution, may carry guns where strictly prohibited).

The resolution is largely ceremonial, as it does not supersede state or federal law, or alter any existing gun laws, as Henderson cited Kentucky Revised Statute 65.870, which states: “No city, county or urban-county government may occupy any part of the field of regulation of the transfer, ownership, possession, carrying or transportation of firearms, ammunition, or components of firearms or combination thereof.”

Grayson County, with Tuesday’s vote, became the 15th Kentucky county to be designated a Second Amendment Sanctuary county.
